Project Delays

Failure to provide requested information or approvals may result in project delays, additional costs, or reduced effectiveness of the Services.

4. Fees and Payment

Payments Terms 

Clients agree to pay all fees outlined in the applicable proposal, invoice, or service agreement.

Deposits

Certain projects require an upfront deposit before work begins.

Final Payment

The remaining balance is due upon project completion or according to the agreed payment schedule.

Late Payment

Late payments may result in suspended Services, additional fees, or interest as permitted by law.

5. Refund Policy

Eligibility for Refunds

Because our Services are customized and strategic, all sales are considered final.

Refunds may only be granted when:

• No Services have been performed.
• A written cancellation request is received within forty-eight (48) hours of the initial payment.

Partial Refunds

Partial refunds may be issued solely at the discretion of Apex Digital Pro LLC.

• Sales
• Leads
• Website traffic
• Book sales
• Media coverage
• Conversion rates

Business results depend on numerous external factors beyond our control.

7. Intellectual Property

Client-Owned Materials

All materials provided by the client remain the client’s property.

Company-Owned Materials

Marketing strategies, designs, creative assets, advertising campaigns, and related work created by Apex Digital Pro LLC remain our intellectual property until full payment is received.

Portfolio Rights

We may showcase non-confidential completed work in our portfolio or promotional materials.

8. Confidentiality

Confidential Information

Both parties agree to protect confidential and proprietary information disclosed during the business relationship.

Continuing Obligation

This confidentiality obligation continues after the Services have ended.

9. Third-Party Tools and Platforms

Third-Party Services

Our Services may utilize platforms such as Google, Meta, Amazon, Mailchimp, YouTube, and other third-party providers.

Platform Responsibility

We are not responsible for outages, algorithm updates, policy changes, or performance issues caused by third-party platforms.

10. Limitation of Liability

Disclaimer of Liability

To the fullest extent permitted by law, Apex Digital Pro LLC shall not be liable for indirect, incidental, consequential, or special damages arising from the use of our Site or Services.

Maximum Liability

Our total liability shall not exceed the amount paid for the specific Service giving rise to the claim.

11. Termination

Termination by Apex Digital Pro LLC

We reserve the right to suspend or terminate Services if a client:

Violates these Terms.
Fails to make required payments.
Engages in fraudulent or abusive conduct.

Termination by Client

Clients may terminate Services by providing fourteen (14) days’ written notice, subject to payment for Services already rendered.

12. Changes to Terms

Updates

We may revise these Terms periodically. Updated versions will be posted on this Site with a revised Effective Date.

Continued use of the Site or Services constitutes acceptance of the updated Terms.

13. Governing Law

Applicable Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of North Carolina, United States.
